What is Involved in a Relative or Stepparent Adoption?
Before anyone can adopt a child, the rights of the biological parent must first be terminated. This is usually done with the consent of the biological parent.
In some cases a biological parent may be missing and his or her whereabouts unknown. In this case, the biological parent’s rights can be terminated after one year during which he or she has had no contact with the child.
Grandparents and other relatives who are caring for a child have a choice of seeking guardianship or adoption. Adoption is chosen when there is no chance that the biological parent can resume his or her role in caring for the child.
Adoption provides a child the stability of having a permanent home and gives the adopted child the right to inherit. It also give the adoptive parent the same rights that a biological parent has, including the right to make medical decisions, enroll a child in school and cover a child under an employer’s health care plan.
The legal process includes filing a petition with the probate court, providing references, and having a social worker visit your home and make a recommendation to the court. The process can be completed within a few months if the adoption is not contested by the biological parent.
